Acceptance
These terms govern membership and use of Cherryverse(the “salon,” “service,” “we,” or “us”). By accepting an invitation, redeeming a code, requesting a seat, or otherwise using the service, you agree to these terms, to the Content Policies, and to the Privacy Notice.
If you do not agree, please do not use the service.
Eligibility
Membership is offered only to adults of legal age in their place of residence, and in no case to anyone under the age of eighteen. By becoming a member you confirm that you meet this requirement, that you have the legal capacity to enter into these terms, and that your use of the service is not prohibited by any law that applies to you.
The nature of the service
The salon is an artificial-intelligence companion service. The personalities you converse with are fictional and are produced by AI systems that we operate. They are not real people, they do not have lives outside the conversation, and any resemblance to a real person, living or dead, is unintended. All AI-generated content produced by the service is identified as AI-generated so that members are aware that the content they see and hear is synthetic.
You should not rely on the service for advice — medical, legal, financial, or otherwise — and you should not represent AI-generated material as authentic, as a real person’s statements, or as a record of real events.
Your account
Membership is personal and non-transferable. You are responsible for the credentials associated with your account and for any activity carried out through it. You agree to use a strong, unique password and to notify us promptly at [email protected] if you suspect your account has been accessed by someone else.
Acceptable use
You agree to use the service only for its intended purpose and in accordance with the Content Policies, which sets out, in full, the categories of content and conduct that are prohibited. By way of summary — and without limiting that policy — you agree not to:
- Create, request, upload, or generate any content within a prohibited category, including content involving minors, non-consensual scenarios, deepfakes or non-consensual likeness use, illegal activity, or hate speech.
- Use the service to harass, threaten, defame, or impersonate any person.
- Attempt to circumvent, disable, or interfere with the safety, moderation, or rate-limiting features of the service.
- Attempt to access another member’s account, data, or conversations.
- Reverse-engineer, scrape, or systematically extract content from the service except as expressly permitted.
- Use the service to develop, train, or evaluate a competing product.
- Use the service in violation of any law that applies to you.
We may remove content, suspend access, or terminate membership for conduct that violates these terms or the Content Policies.
Membership, billing, and refunds
Where a membership is offered for a fee, the fee, the billing interval, and any applicable taxes are shown to you at the point of subscription. Payment is processed by our payment processor; we do not see or store your card details.
Memberships renew automatically at the end of each interval at the then-current rate, unless you cancel before the renewal date. You may cancel at any time through the service or by writing to [email protected]; cancellation stops the next renewal and leaves you with access until the end of the current paid period.
Memberships are non-refundable except where required by law or where we, at our discretion, decide otherwise. Where membership is terminated for cause — for example, a violation of the Content Policies — fees are not refunded.
Intellectual property
The salon, including its design, software, content, and trademarks, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the service in accordance with these terms.
You retain ownership of the content you submit to the service. You grant us a worldwide, royalty-free licence to host, store, process, and display that content solely to operate the service for you. We do not use member content to train models, to improve our service generally, or for any purpose beyond providing the service to you.
Copyright concerns are addressed through the notice-and- takedown procedure described in the Content Policies.
Privacy
Our handling of member information is described in the Privacy Notice. In short: conversations are encrypted, are not accessed by staff except where legally compelled, and are not shared with, sold to, or used by third parties. All our systems are hosted in-house on infrastructure we own and operate.
Termination
You may close your account at any time by writing to [email protected]. We may suspend or terminate any account, with or without notice, where these terms or the Content Policies have been violated, where required by law, or where we determine in good faith that doing so is necessary to protect members, the public, or the integrity of the service.
Provisions that, by their nature, should survive termination — including intellectual-property provisions, disclaimers, limitations of liability, and the indemnity below — will survive.
Disclaimers
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including any warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that the AI will produce accurate, complete, or useful information.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with the service. Our aggregate liability arising out of or relating to these terms or the service will not exceed the greater of (a) the amount you paid us for the service in the twelve months before the event giving rise to the claim, or (b) one hundred United States dollars (USD 100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.
Indemnification
You agree to indemnify and hold harmless the salon and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your violation of these terms or the Content Policies, (b) your violation of any law or the rights of any third party, or (c) content you submit to the service.
Changes to these terms
We may update these terms from time to time. Where a change is material we will notify members in the service before the change takes effect. Continuing to use the service after a change has taken effect constitutes acceptance of the updated terms. The date at the top of this page reflects the most recent revision.
Governing law and disputes
These terms are governed by the laws of the jurisdiction in which the salon is operated, without regard to its conflict-of- law principles. Disputes will be resolved in the courts of that jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual-property rights.
